Terms of Service
These terms govern your use of TedScout. By creating an account or using the service, you agree to these terms. Please read them — they are written in plain language.
1. Who we are
TedScout is operated by the operator of TedScout ("we", "us", "our"). The service is accessible at tedscout.eu. For questions about these terms, contact us at support@tedscout.eu.
2. The service
TedScout provides access to EU public procurement data via a Model Context Protocol (MCP) server. The service allows you to search, monitor, and analyse public tender notices published on TED (Tenders Electronic Daily) and national procurement portals across EU member states.
All tender data retrieved by TedScout is sourced from publicly available government procurement databases. We do not create, modify, or guarantee the accuracy of this data — it is published by contracting authorities and reproduced as-is.
3. Accounts
To use TedScout you must create an account with a valid email address. You are responsible for:
- Keeping your password and API key confidential.
- All activity that occurs under your account.
- Notifying us immediately at support@tedscout.eu if you suspect unauthorised access.
You must be at least 18 years old to create an account. Accounts are for individual or organisational use — you may not share your account or API key with third parties outside your organisation.
4. Acceptable use
You may use TedScout for any lawful commercial purpose, including finding tenders, monitoring procurement opportunities, and preparing bid responses.
You may not:
- Use the service to scrape, resell, or redistribute tender data at scale without our written consent.
- Attempt to reverse-engineer, circumvent rate limits, or access the API beyond your plan's allocated request limits.
- Use the service in any way that violates applicable laws or regulations.
- Share your API key publicly or embed it in client-side code.
- Use automated scripts to generate API calls beyond normal usage patterns without prior agreement.
5. Subscription and payment
TedScout is offered on a subscription basis. Pricing is set out at tedscout.eu. Subscriptions renew automatically at the end of each billing period unless cancelled.
Payments are processed by Creem.io. By subscribing, you also agree to Creem's payment terms. We do not store payment card details.
A 14-day free trial is available on all paid plans. No credit card is required to start a trial. At the end of the trial, access continues only if a paid subscription is activated.
Refunds are handled on a case-by-case basis. Contact support@tedscout.eu within 7 days of a charge if you believe a refund is warranted.
6. Rate limits and fair use
Each plan includes a daily and per-minute request limit. Exceeding these limits will result in requests being rejected with a 429 response. Persistent or deliberate abuse of rate limits may result in account suspension.
We reserve the right to adjust rate limits with reasonable notice to maintain service quality for all users.
7. Data and privacy
Our collection and use of your personal data is governed by our Privacy Policy, which forms part of these terms. By using TedScout you agree to the Privacy Policy.
8. AI-generated content
Some TedScout tools (including tender summaries, go/no go recommendations, and bid outlines) use AI language models to generate content. This content is provided for informational and planning purposes only. It does not constitute legal, financial, or professional advice. You are responsible for verifying AI-generated content before relying on it for any commercial decision.
9. Intellectual property
The TedScout software, brand, and documentation are owned by the operator of TedScout. Tender data is sourced from public government databases and remains the property of the respective contracting authorities and the Publications Office of the EU.
You retain ownership of any company profile data, watchlist configurations, and tender ratings you create within the service.
10. Availability and uptime
We aim to keep TedScout available at all times but do not guarantee uninterrupted access. The service may be unavailable during maintenance windows or due to circumstances outside our control. We will endeavour to provide advance notice of planned downtime.
TED and national portal APIs are operated by third parties. Temporary unavailability of these sources may affect search results. We are not liable for data gaps caused by upstream source outages.
11. Limitation of liability
To the maximum extent permitted by law, TedScout is provided "as is" without warranty of any kind. We are not liable for:
- Missed tender deadlines or procurement opportunities.
- Inaccuracies in tender data sourced from third-party portals.
- Decisions made on the basis of AI-generated content.
- Loss of revenue, contracts, or business opportunities.
- Any indirect, consequential, or incidental damages.
Our total liability to you for any claim arising from use of the service is limited to the amount you paid us in the three months preceding the claim.
12. Termination
You may cancel your account at any time from the Subscription tab in your dashboard. On cancellation, your access continues until the end of the current billing period.
We may suspend or terminate accounts that violate these terms, with or without notice depending on severity. In cases of suspected fraud or security incidents, suspension may be immediate.
On termination, your data is retained for 30 days then deleted in accordance with our Privacy Policy.
13. Changes to these terms
We may update these terms from time to time. Material changes will be communicated by email to registered users at least 14 days before taking effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.
14. Governing law
These terms are governed by the laws of the European Union and, where applicable, the laws of the jurisdiction in which the operator of TedScout is established. Any disputes shall be resolved in the courts of that jurisdiction.
